Welcome to SwimAcademy, LLC (“SwimAcademy,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, services, mobile messaging program, and related products. By accessing or using our services, you agree to these Terms.

1. Our Services

SwimAcademy provides online swim training through:

  • Video Programs Plan – access to structured training video courses.

  • Private Coaching Plans – direct athlete video analysis and personalized feedback.

  • Referral Program – where users can earn free months by referring new subscribers.

  • Free Trial – available to all new customers.

2. Subscriptions, Billing & Automatic Renewals

  • All subscriptions automatically renew each billing cycle unless canceled before the renewal date.

  • If you cancel, you will continue to have access until the end of your current billing period.

  • No prorated refunds are offered. Your first month is always free, and cancellations must occur before the next billing cycle to avoid charges.

3. Eligibility

  • Services are for adults (18+) who are the account holders.

  • Parents may set up accounts on behalf of their children. SwimAcademy is not intended for direct use by minors without parental consent and supervision.

4. SMS/Text Messaging Program

By opting into SwimAcademy’s SMS program, you agree to receive recurring text messages from SwimAcademy, including reminders, coaching updates, promotional messages, and alerts.

  • Consent: By providing your phone number at checkout, registration, or event signup, you consent to receive SMS messages from SwimAcademy.

  • Opt-Out: You may unsubscribe at any time by replying STOP.

  • Help: For assistance, reply HELP or contact us at info@swimacademyusa.com.

  • Frequency: Messages may be recurring; frequency varies by user activity and subscription status.

  • Message/Data Rates: Standard message and data rates may apply.

  • Privacy: Your phone number will only be used for SwimAcademy communications. We do not sell or share SMS data with third parties for marketing.

5. Event & Clinic Registrations

When registering for a SwimAcademy clinic or event:

  • You must provide accurate first/last name, email, and phone number.

  • All communications, including reminders and updates, may be sent via SMS and email.

6. Refunds & Cancellations

  • We do not offer refunds once billing has occurred.

  • Subscriptions must be canceled before the next billing cycle to avoid additional charges.

  • Canceled subscriptions remain active through the end of the billing period.

7. Liability Waiver

By participating in SwimAcademy programs (online or in person), you acknowledge that swimming and physical activity carry inherent risks. SwimAcademy, its staff, and affiliated athletes are not liable for injuries, damages, or losses that may occur through participation.

8. Intellectual Property

All content on SwimAcademy platforms, including videos, training materials, graphics, and logos, are the property of SwimAcademy, LLC. You may not reproduce, share, or distribute without prior written consent.

9. Privacy & Data Collection

  • We collect information such as your name, email, and phone number for account setup, billing, and SMS communication.

  • SMS consent records are stored for compliance.

  • We do not sell your personal data to third parties.

10. Termination

We reserve the right to suspend or terminate access if you violate these Terms.
